Welcome to my website! By accessing and using this website, you agree to comply with and be bound by the following terms and conditions of use. Please read these terms carefully before making a purchase. If you do not agree to these terms, you should not use this website.
General Information
This website is owned and operated by me, Danielle Clough ("I," "me," "my"). I sell embroidery artwork and fine art prints to customers in South Africa and internationally.
By purchasing from my website, you confirm that you are at least 18 years old or have permission from a parent or legal guardian to make purchases.
I reserve the right to modify these Terms and Conditions at any time. Updates will be posted on this page, and your continued use of the website constitutes acceptance of any changes.
2. Products
2.1 All products are handmade or created with artistic care, and as such, slight variations in colour, texture, or design may occur. These variations are not defects but are inherent to the nature of the artwork.
2.2 I endeavour to display all product images and descriptions as accurately as possible. However, colours may vary slightly due to different screen settings.
3. Pricing and Payment
3.1 Prices are displayed in South African Rand (ZAR) and may include or exclude VAT, depending on applicable laws. For international customers, the price excludes customs duties, taxes, and import fees, which are your responsibility.
3.2 I accept various payment methods, including credit cards, debit cards, and other payment options as listed at checkout. Payments are processed securely.
3.3 I reserve the right to change prices at any time without prior notice. Prices at the time of your purchase will apply.
4. Shipping and Delivery
4.1 I offer local and international shipping. Shipping costs will be calculated and displayed during checkout.
4.2 Delivery times are estimates and depend on the shipping destination. I am not responsible for delays caused by customs, shipping carriers, or other factors beyond my control.
4.3 International customers are responsible for any customs duties, taxes, or import fees required by their country’s regulations.
5. Returns and Refunds
5.1 Due to the handmade nature of my products, all sales are final, and I do not offer returns or exchanges unless the product is defective or damaged in transit.
5.2 If you receive a damaged or defective product, you must notify me within 7 days of receiving the item by emailing hello[at]danielleclough.com with photographic evidence. Please note that shipping insurance is not offered at checkout. However, if you would like to process a claim with the shipper for shipping liability cover, I will share the applicable forms so that a claim can be logged. I cannot guarantee the success of such claims.
5.3 Refunds are issued at my discretion and only in the original payment method.
6. Care Instructions
Rackets:
Keep the rackets out of direct sunlight and away from moisture. They are very beautiful (and happy) framed.
Due to the nature of the vintage rackets, I cannot make any guarantees for warping that may (possibly) happen over time. However, I’ve never seen it happen with one of my works.
Prints:
All prints are on archival paper and printed with acid-free ink.
Framing is recommended. Please keep out of direct sunlight to preserve their longevity. (This goes with most things in life, I think.)
Pieces in Hooplas and Vintage Frames:
These are happiest out of direct sunlight and framed, but they can be hung as is!
7. Reproduction of Artwork
Because I want to spread embroidery joy as far as possible, I may make prints of any of the pieces I create for sale unless this is discussed prior. If you have any questions or concerns, PLEASE feel free to contact me at hello[at]danielleclough.com.
8. Intellectual Property
8.1 All content on this website, including images, text, and designs, is my intellectual property unless otherwise stated. Unauthorised use, reproduction, or distribution of my content is prohibited.
8.2 The purchase of artwork does not transfer copyright ownership. You may not reproduce, resell, or use the artwork for commercial purposes without my prior written consent.
9. Limitation of Liability
9.1 I make every effort to ensure that this website is secure and error-free. However, I cannot guarantee uninterrupted access or that the site is free of bugs, viruses, or errors.
9.2 To the maximum extent permitted by law, I shall not be held liable for any direct, indirect, incidental, or consequential damages arising from your use of this website or your purchase of my products.
10. Indemnification
10.1 By using this website, you agree to indemnify, defend, and hold harmless me, Danielle Clough, and any employees or agents from any claims, damages, losses, or expenses arising from your breach of these Terms and Conditions or your use of my products.
11. Governing Law
11.1 These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
